1. Introduction

Welcome to Truth Tunes™. These Terms, Policies, and Legal Agreements (“Terms”) govern your use of our website, services, social platform, and AI-powered tools (together, the “Platform”). By accessing or using Truth Tunes™, you agree to be bound by these Terms.

In this document:

“Truth Tunes™,” “we,” “our,” or “us” refers to the company, its patented technologies, trademarks, and services.
“You” or “User” refers to any individual accessing, registering, or participating in the Platform.

Please read these Terms carefully, as they outline your rights, responsibilities, and our commitments to you. If you do not agree, you must discontinue use of the Platform.

2. Intellectual Property & Ownership

2.1 Exclusive Rights
Truth Tunes™, including its proprietary framework, methodologies, concepts, and technologies (collectively, the “Truth Tunes™ Platform”), are and shall remain the sole and exclusive property of JB Empire™. This expressly includes, without limitation, the Lakeside Hub™ concept, the Recognition Revolution™ framework, and all related innovations, whether past, present, in development, forthcoming, or otherwise iterated. These proprietary assets are protected by U.S. and international copyright, trademark, patent, trade secret, and moral rights law. Any unauthorized use, replication, misappropriation, or attempt to develop derivative or substantially similar works shall be considered an infringement and will be prosecuted vigorously.

2.2 Trademarks & Proprietary Marks
Truth Tunes™, JB Empire™, Lakeside Hub™, Recognition Revolution™, and any associated logos, slogans, or distinctive identifiers are proprietary trademarks and service marks of JB Empire™. These marks include pending, registered, and unregistered marks and are protected under U.S. and international trademark laws. All goodwill arising from use of these marks shall inure exclusively to JB Empire™. No rights or licenses are conferred to Users by implication, estoppel, or otherwise. Unauthorized use, imitation, dilution, or commercial exploitation constitutes infringement and will be pursued to the fullest extent permissible by law.

2.3 Copyright
All original materials contained within the Platform, including without limitation the structure, organization, look-and-feel, algorithms, media assets, AI models, software code, and creative content, are protected by copyright and remain the sole property of JB Empire™. This also includes compilations, collective works, and curated arrangements of user content hosted or displayed on the Platform. Users are granted only a limited, revocable license for personal, non-commercial use, and no ownership rights are conferred. AI-generated works created via the Truth Tunes™ Platform remain subject to JB Empire’s™ rights, and while Users may access, share, and enjoy such works as permitted, no assignment of ownership is made. Creation or distribution of derivative or lookalike works is strictly prohibited.

2.4 Prohibited Activities
No User or third party may:

Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source, structure, or underlying methodologies of the Platform or its proprietary technologies;
Data mine, scrape, or otherwise harvest content, algorithms, or user information from the Platform for external use or to train artificial intelligence models;
Circumvent, disable, or interfere with security, copyright management, or access control systems;
Commercialize, monetize, or otherwise exploit JB Empire’s™ intellectual property, trademarks, or proprietary concepts without prior written authorization;
Claim, register, or attempt to enforce rights in any mark, name, or concept confusingly similar to those of JB Empire™;
Misappropriate trade secrets, confidential methodologies, or non-public technologies of JB Empire™.

2.5 Reservation of Rights & Enforcement
JB Empire™ reserves and retains all rights, title, and interest in its intellectual property, proprietary concepts, and frameworks worldwide. This protection extends to all present and future proprietary concepts, frameworks, or methodologies developed under Truth Tunes™ or JB Empire™, whether or not explicitly listed herein. No license, ownership, or implied rights are granted except as expressly set forth in these Terms. JB Empire™ expressly reserves the right to pursue injunctive relief, equitable relief, monetary damages, statutory penalties, recovery of attorneys’ fees and costs of enforcement, and all remedies available under law against any party who infringes, misuses, or attempts to replicate its intellectual property.

3. Use of the Platform

3.1 Eligibility; Minimum Age; Parental Consent
a. To access or use the Platform you must be at least 13 years of age. If you are under the age of majority in your jurisdiction (for example, under 18 in many places), you may only use the Platform with the consent and active supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
b. Where local law sets a higher minimum age for the processing of personal data (including but not limited to certain EU/EEA jurisdictions), you must comply with that local requirement — if you are below that age you must not register or use the Platform except through verified parental or guardian consent. Truth Tunes™ may require verification of parental consent where required by law.
c. The Platform is not intended for persons barred from receiving services under applicable law, or for users located in countries or territories where use would violate trade, export, or economic sanctions. You represent and warrant that you meet all eligibility requirements and that your access and use of the Platform do not violate any applicable law.
3.2 Account Registration, Accuracy & Security
a. Certain features require creation of a user account. When registering you must provide accurate, complete, and current information and promptly update that information to keep it accurate.
b. You are responsible for maintaining the confidentiality of your account credentials and any activity that occurs under your account. You must notify Truth Tunes™ immediately if you suspect any unauthorized use of your account or breach of security.
c. You are solely responsible for all actions taken under your account, including purchases, communications, and content posted. Truth Tunes™ is not liable for losses arising from unauthorized use of your account unless caused by our gross negligence or willful misconduct.
d. Accounts are non-transferable. You may not sell, assign, license, or otherwise transfer your account, username, password, or any rights in or to your account without Truth Tunes™’ prior written consent.
e. Truth Tunes™ may offer or require additional authentication measures (e.g., two-factor authentication) and may temporarily restrict account access pending security verification. You agree to cooperate with any reasonable identity or security checks Truth Tunes™ requests.
3.3 Account Verification & Identity Proofing
a. Truth Tunes™ may, at its discretion, require identity verification before permitting use of certain features (including high-risk transactions, monetization features, or to comply with legal obligations). You agree to provide accurate verification documentation if requested.
b. Failure to provide requested verification information may result in suspension or termination of your access to some or all Platform features.
3.4 Permitted Use; License to Access
a. Subject to these Terms, Truth Tunes™ grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for lawful, personal, non-commercial purposes unless you have a separate agreement authorizing commercial use.
b. You may access and use the Platform only via the interfaces, APIs, and functionality we provide. You may not access the Platform by any other means (e.g., direct network calls contrary to our published APIs) or through attempts to emulate or replicate our services.
3.5 Prohibited Conduct (Non-Exhaustive)
Without limiting any other provision of these Terms, you must not, and must not assist, enable, or allow others to:
a. violate any applicable law, regulation, court order, or third-party right;
b. post, upload, transmit, or otherwise make available any content that is unlawful, defamatory, obscene, pornographic involving minors, exploitative, abusive, threatening, harassing, hateful, or that encourages imminent violence;
c. upload or transmit viruses, worms, Trojan horses, ransomware, spyware, adware, or other malicious code or harmful components;
d. use the Platform to engage in phishing, doxxing, stalking, identity theft, or otherwise collect or publish private information about a third party without consent;
e. infringe, misappropriate, or otherwise violate the intellectual property or proprietary rights of others (including uploading copyrighted works you do not own or have rights to);
f. scrape, spider, mine, index, or otherwise automatically collect data or content from the Platform (including for the purpose of training or improving machine learning or AI models) without express written permission from Truth Tunes™;
g. use bots, crawlers, scripts, automated agents, or other automated means to access, interact with, or perform any action on the Platform except where expressly permitted in writing;
h. reverse-engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or underlying structure of the Platform or any of its components;
i. circumvent or attempt to circumvent any technological protection measures, access control, rate limits, or other security features implemented by Truth Tunes™;
j. create multiple accounts to avoid enforcement actions, circumvent limitations or bans, or manipulate any ranking, recommendation, or reward systems;
k. use the Platform to create, post or promote content that is primarily intended to sell, market, or solicit illegal goods or services; or
l. attempt to monetize, resell, or commercially exploit the Platform or its outputs (including AI-generated music or content) unless expressly authorized by Truth Tunes™ via a separate licensing agreement.
3.6 Automated Tools; API Use & Developer Access
a. If and when Truth Tunes™ exposes APIs, developer tools, or other programmatic access, such access will be governed by additional API terms and acceptable-use policies. You must comply with any rate limits, attribution, and use restrictions we publish.
b. Unauthorized programmatic access, automated scraping, or usage that imposes undue load on the Platform is strictly prohibited and may result in immediate termination.
3.7 Shared Devices, Third-Party Authentication & Account Sharing
a. You are responsible for access to the Platform from any device that uses your account. If you share credentials you remain responsible for all actions that occur under your account.
b. If you register or sign-in using a third-party account (such as Google, Apple, Facebook), you authorize Truth Tunes™ to access information from that third party in accordance with our Privacy Policy, and you represent that you have the right to grant us access to that third-party account data.
3.8 Suspension, Termination & Remediation
a. Truth Tunes™ may suspend, restrict, or terminate your access to the Platform, or remove any content, at any time and without notice if you breach these Terms, if required by law, or to protect users, the Platform, or our business interests. In cases of serious or repeated violations, Truth Tunes™ may pursue permanent account termination.
b. In the event of suspension or termination, Truth Tunes™ may delete or retain copies of your content and account information as required by law or for legitimate business purposes; Truth Tunes™ is not liable to you or any third party for suspension, termination, or deletion of your content or account.
c. If you believe an action was taken in error, you may contact our support team at the address in Section 16 for further review; Truth Tunes™ reserves the right to refuse reinstatement pending investigation.
3.9 Account Recovery, Data Retention & Access to Content
a. Truth Tunes™ may retain and archive certain user data and content after account termination to comply with legal obligations, enforce our rights, or for legitimate business needs.
b. You should maintain local copies of any content you value; Truth Tunes™ does not guarantee indefinite storage of user content.
c. Requests to recover deleted content are subject to Truth Tunes™’ policies and may be denied.
3.10 Geographic Restrictions; Export Controls; Sanctions Compliance
a. You may not use the Platform in a territory or for a purpose that would violate applicable export control, sanctions, or trade laws (including for persons or entities on restricted or denied-party lists). Truth Tunes™ may restrict or block access from certain countries or IP ranges to comply with legal obligations.
b. You represent that you are not located in, under the control of, or a national or resident of any territory sanctioned by applicable law.
3.11 Cooperation with Law Enforcement; Subpoenas & Preservation of Logs
a. Truth Tunes™ may preserve and disclose information about your account, content, or actions in response to lawful requests by public authorities, subpoenas, or to protect the safety or legal rights of users and third parties.
b. By using the Platform you consent to such disclosures when required by law or necessary to protect the Platform or its users.
3.12 User Representations & Warranties (by using the Platform you represent that)
a. you are legally capable of entering into and performing under these Terms;
b. any content you submit does not violate these Terms or third-party rights;
c. you will comply with all applicable laws in connection with your use of the Platform; and
d. you will cooperate with Truth Tunes™ in investigating suspected violations.

4. AI Services

4.1 Nature of AI Outputs
a. Truth Tunes™ provides access to proprietary artificial intelligence (“AI”) systems that may generate text, music, audio, visuals, or other creative or functional outputs (collectively, “AI Outputs”).
b. You acknowledge and agree that AI Outputs are generated algorithmically, may not be unique to you, and may in some cases resemble or overlap with pre-existing works or publicly available material.
c. AI Outputs are not guaranteed to be original, accurate, reliable, or free of third-party rights, and may contain errors, distortions, or unintended content.
d. Truth Tunes™ makes no representation, warranty, or guarantee regarding the originality, ownership, accuracy, reliability, non-infringement, merchantability, or fitness for a particular purpose of any AI Outputs.
4.2 Ownership of AI Outputs
a. Subject to compliance with these Terms, and unless otherwise expressly stated in a separate written agreement, users are granted a limited, revocable, non-exclusive, non-transferable, worldwide license to use AI Outputs for lawful, personal, non-commercial purposes only.
b. JB Empire™ retains all right, title, and interest in and to:
The AI models, frameworks, algorithms, training data, and related intellectual property;
All system-generated metadata and logs associated with AI service use;
All improvements, modifications, or derivative works to the AI systems.
c. No rights, titles, or interests in the underlying technology, models, or intellectual property are transferred to users.
4.3 Prohibited Uses of AI Outputs
You agree not to use AI Outputs, or any derivative works thereof, in any manner that:
Infringes, misappropriates, or violates the rights of any third party, including intellectual property, publicity, moral, or privacy rights;
Creates, promotes, or disseminates defamatory, obscene, hateful, discriminatory, harassing, exploitative, violent, fraudulent, misleading, or otherwise unlawful material;
Misrepresents AI Outputs as human-created when doing so is intended to deceive, impersonate, or manipulate;
Promotes or facilitates violence, terrorism, exploitation of minors, self-harm, or other criminal activity;
Uses AI Outputs to train, reverse-engineer, or improve other AI models or systems without express written consent;
Circumvents, disables, or interferes with security, usage limits, or monitoring features of the Platform.
4.4 Commercial Use Restrictions
a. Users may not reproduce, distribute, publicly perform, sell, license, sublicense, or otherwise exploit AI Outputs for commercial purposes without the prior written consent of JB Empire™.
b. Unauthorized commercial use constitutes infringement and breach of these Terms and may result in immediate account termination, civil enforcement, and pursuit of damages.
c. JB Empire™ reserves the right to offer separate commercial-use licensing terms or enterprise agreements, which may include royalties, fees, or other conditions.
4.5 User Responsibility for AI Outputs
a. You acknowledge and agree that you are solely responsible for evaluating, verifying, and lawfully using any AI Outputs.
b. Truth Tunes™ does not pre-screen, monitor, or verify AI Outputs prior to delivery and expressly disclaims all liability for any reliance on, or use of, such outputs.
c. You agree to indemnify, defend, and hold harmless JB Empire™, Truth Tunes™, its affiliates, officers, employees, and licensors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to your use, misuse, reliance on, or publication of AI Outputs, including but not limited to claims of infringement, defamation, or violation of third-party rights.
4.6 No Guarantee of Performance or Suitability
a. AI services are experimental and provided “AS IS” and “AS AVAILABLE.”
b. Outputs may be incomplete, inaccurate, offensive, biased, or unsuitable for reliance in professional, medical, legal, financial, or safety-critical contexts.
c. Truth Tunes™ does not guarantee the availability, reliability, quality, or performance of AI services and shall not be liable for interruptions, errors, or failures in generating AI Outputs.
4.7 Feedback & Improvements
a. Any suggestions, feedback, or improvements you provide regarding AI services are deemed the sole property of JB Empire™.
b. By submitting feedback, you irrevocably assign and transfer all rights, title, and interest in such feedback to JB Empire™ without any obligation of attribution, accounting, or compensation.
4.8 Reservation of Rights
JB Empire™ expressly reserves all rights not granted to you in these Terms, including but not limited to the right to:
Monitor usage of AI services for compliance with these Terms;
Limit, restrict, suspend, or revoke access to AI services at any time, with or without notice;
Enforce restrictions against misuse or unauthorized commercial exploitation;
Modify, update, or discontinue AI services at its sole discretion.

5. User Content & Conduct

5.1 Ownership of User Content
You retain ownership of any intellectual property rights you hold in the content you create, post, upload, submit, transmit, or otherwise make available through the Platform (“User Content”). However, by submitting User Content, you hereby grant Truth Tunes™ and JB Empire™ a worldwide, perpetual, irrevocable, royalty-free, fully-paid, transferable, sublicensable license to use, host, store, reproduce, modify, adapt, translate, publish, distribute, publicly perform, publicly display, and create derivative works from your User Content in connection with (i) the operation, provision, promotion, and improvement of the Platform; (ii) the marketing and promotion of Truth Tunes™, JB Empire™, and related initiatives; and (iii) compliance with legal and regulatory requirements. This license survives termination of your account and cannot be revoked to the maximum extent permitted by law.
5.2 Representations & Warranties
By submitting User Content, you represent and warrant that:
You own or control all necessary rights to grant the license above;
Your User Content does not infringe, misappropriate, or violate any third party’s intellectual property, publicity, privacy, contractual, or other proprietary rights;
Your User Content complies with all applicable laws, rules, and regulations;
Your User Content is not fraudulent, deceptive, misleading, or intended to impersonate others;
You have obtained all necessary consents and permissions from any identifiable individuals or third parties appearing in your User Content;
Your User Content will not expose Truth Tunes™, JB Empire™, or their affiliates to liability of any kind.
5.3 Prohibited Content
You agree not to upload, post, transmit, or otherwise make available any User Content that:
Contains unlawful, defamatory, libelous, obscene, pornographic, indecent, harassing, threatening, abusive, hateful, discriminatory, or otherwise objectionable material;
Promotes or incites violence, self-harm, terrorism, exploitation, criminal conduct, or any illegal activity;
Infringes or violates any intellectual property rights or other proprietary rights of a third party;
Contains malware, spyware, ransomware, viruses, or any malicious or harmful code;
Attempts to circumvent, disable, or interfere with security features, monitoring tools, or content filters;
Constitutes spam, bulk messages, chain letters, pyramid schemes, unsolicited advertising, or unauthorized commercial solicitation;
Misrepresents the source, origin, or authenticity of User Content or impersonates any individual, entity, or organization.
5.4 Responsibility & Indemnification
You are solely responsible for your User Content and any consequences arising from posting or sharing it. Truth Tunes™ does not endorse, control, or guarantee the accuracy of User Content. You agree to defend, indemnify, and hold harmless Truth Tunes™, JB Empire™, their affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your User Content, your conduct, or your violation of these Terms.
5.5 Monitoring & Enforcement
Truth Tunes™ reserves the unconditional right, at its sole discretion and without obligation, to:
Monitor, screen, review, pre-screen, edit, or remove any User Content at any time, without notice, for any or no reason;
Suspend, restrict, or terminate User accounts or access for conduct that violates these Terms or applicable law;
Cooperate with law enforcement, regulators, and rights-holders by disclosing identity, activity, or other account information as required or permitted by law;
Take any legal, technical, or operational measures necessary to protect the rights, property, and safety of Truth Tunes™, JB Empire™, users, and the public.
You expressly waive any claim against Truth Tunes™ or JB Empire™ arising from the removal, modification, or restriction of access to any User Content.
5.6 Feedback & Suggestions
If you provide Truth Tunes™ with suggestions, feedback, improvements, or other input related to the Platform (“Feedback”), you hereby assign all right, title, and interest in such Feedback to JB Empire™. To the extent such assignment is not enforceable, you grant Truth Tunes™ and JB Empire™ a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, disclose, reproduce, adapt, and otherwise exploit such Feedback without restriction or compensation.
5.7 Survival
All rights, licenses, disclaimers, and obligations set forth in this Section 5 shall survive termination or expiration of these Terms, to the maximum extent permitted by law.

6. License Granted by Users

6.1 Ownership of User Content
Except for the license granted herein, you retain all ownership rights in and to the content, data, text, images, audio, video, music, audiovisual works, AI-generated contributions, or other materials you upload, post, submit, transmit, or otherwise make available through the Platform (“User Content”). Nothing in these Terms shall be construed as transferring ownership of your User Content to Truth Tunes™ or JB Empire™.
6.2 License Grant to Truth Tunes™
By submitting or posting User Content to the Platform, you grant Truth Tunes™, JB Empire™, and their affiliates, service providers, successors, licensees, and assigns a worldwide, perpetual, irrevocable, royalty-free, fully paid-up, transferable, and sublicensable license to:

Host, store, cache, index, reproduce, transmit, distribute, publicly display, publicly perform, adapt, modify, translate, and create derivative works of the User Content, in whole or in part, in any media or format now known or hereafter developed;
Use, analyze, and process User Content to operate, maintain, improve, promote, and train the Platform and its AI-powered models, algorithms, and services;
Make User Content available to other users of the Platform in accordance with your account settings and the functionality of the Platform;
Sublicense User Content to trusted third-party vendors, partners, hosting providers, or marketing affiliates as reasonably necessary to operate, enhance, secure, or promote the Platform.

This license survives termination of your account and is not revocable except as expressly provided in Section 6.5.
6.3 Waiver of Moral Rights
To the maximum extent permitted by applicable law, you irrevocably waive any and all moral rights, rights of attribution, rights of integrity, and similar rights you may hold in User Content as against Truth Tunes™, JB Empire™, and their sublicensees. You further agree not to assert or enforce any such rights in a manner that would interfere with the rights granted herein.
6.4 Representations & Warranties
By providing User Content, you represent and warrant that:

You own or otherwise control all rights necessary to grant the license set forth in this Section;
The User Content does not and will not infringe, misappropriate, or violate the intellectual property, privacy, publicity, or proprietary rights of any third party;
The User Content complies with these Terms and all applicable laws;
You have obtained and will maintain all necessary consents, waivers, or releases from individuals, entities, or rights-holders appearing in or contributing to your User Content.

6.5 Termination of License
Upon deletion of your User Content from the Platform, Truth Tunes™ will use commercially reasonable efforts to remove it from active display. However, you acknowledge and agree that:

Deleted User Content may persist in cached, backup, archival, or log copies for a commercially reasonable period of time;
User Content already sublicensed, shared, or used in accordance with this Section may continue to exist and be accessible or used by others, subject to their own rights and obligations;
Truth Tunes™ may retain and use copies of your User Content as reasonably necessary to comply with legal obligations, enforce these Terms, resolve disputes, prevent fraud, and maintain operational continuity.

6.6 Survival
The licenses and waivers granted by you under this Section are perpetual and irrevocable with respect to any User Content submitted prior to deletion or termination of your account, except to the limited extent expressly provided under Section 6.5.
6.7 AI-Generated User Content
6.7.1 Definition
For purposes of these Terms, “AI-Generated User Content” means any music, sound recordings, lyrics, text, images, audiovisual works, or other materials generated, in whole or in part, through the use of the Platform’s artificial intelligence tools, features, or services, whether initiated, prompted, or otherwise facilitated by a User.
6.7.2 Ownership Position
To the maximum extent permitted by applicable law:

Truth Tunes™ asserts and reserves all rights, title, and interest in and to the proprietary algorithms, frameworks, prompts, training data, and system outputs underlying or contributing to AI-Generated User Content.
Users retain ownership of any original, protectable contributions they make to AI-Generated User Content (e.g., lyrics, recordings, or creative input provided directly by the User).
In jurisdictions where AI-Generated works may not qualify for copyright protection, Users acknowledge that they may have limited or no enforceable rights in AI-Generated User Content and that Truth Tunes™ may continue to use, display, or distribute such content without liability.

6.7.3 License Grant
By creating, exporting, sharing, or otherwise using AI-Generated User Content through the Platform, you grant Truth Tunes™, JB Empire™, and their affiliates a worldwide, perpetual, irrevocable, royalty-free, fully paid-up, transferable, and sublicensable license to use, reproduce, adapt, modify, distribute, publicly perform, publicly display, host, train, and create derivative works from such AI-Generated User Content for any lawful purpose, including but not limited to platform improvement, marketing, research, and development.
6.7.4 User Responsibilities
You represent and warrant that:

You will not use the AI tools to generate infringing, unlawful, defamatory, or otherwise prohibited content;
You understand and agree that AI-Generated User Content may resemble or overlap with works created by others using the Platform or other AI systems, and that such similarity does not entitle you to exclusive rights or remedies;
You assume all risk that AI-Generated User Content may not be eligible for intellectual property protection in your jurisdiction.

6.7.5 Waiver of Claims
You waive any claim against Truth Tunes™, JB Empire™, or their affiliates arising from:

Similar or identical AI-Generated outputs produced for other Users;
The use, distribution, or commercialization of AI-Generated User Content by Truth Tunes™ or third parties acting under license;
The inability to obtain or enforce exclusive intellectual property rights in AI-Generated User Content.

6.7.6 Survival
All licenses, waivers, and disclaimers set forth in this Section 6.7 survive termination of your account and apply retroactively to any AI-Generated User Content created during your use of the Platform.

7. Social Features & Community Guidelines

7.1 Purpose of Community Features
The Platform includes interactive features such as forums, groups, feeds, messaging, and other community tools (collectively, “Social Features”). These are provided to foster creativity, collaboration, and positive engagement among Users. By accessing or using Social Features, you agree to abide by these Terms, the Community Guidelines, and the spirit of constructive participation.
7.2 User Responsibilities
Users are expected to:

Treat others with respect, civility, and fairness;
Avoid harassment, bullying, stalking, discrimination, intimidation, or targeted abuse;
Keep discussions relevant, accurate, and constructive;

7.3 Prohibited Conduct in Social Features
Without limitation, Users shall not:

Post, transmit, or distribute unlawful, defamatory, obscene, hateful, violent, pornographic, exploitative, or otherwise harmful material;
Engage in spam, solicitation, multi-level marketing, commercial advertising, or self-promotion without express authorization;
Misrepresent identity, impersonate others, mislead Users, or create multiple/fraudulent accounts to evade restrictions or suspensions;
Solicit, exploit, or endanger minors, or distribute sexually explicit, suggestive, or exploitative content;
Use Social Features for scams, phishing, fraudulent schemes, or to distribute malware or malicious code;
Interfere with normal operation of the Platform, disrupt community events, or attempt to manipulate ranking, visibility, or engagement metrics.

7.4 Moderation Rights
JB Empire™ reserves the absolute right, but not the obligation, to monitor, screen, edit, remove, archive, or disable access to any content, communication, or account, in whole or in part, at its sole discretion and without notice. This includes actions taken to:

Enforce these Terms, Community Guidelines, or applicable law;
Protect the safety, security, and integrity of the Platform and its Users;
Address complaints, violations, or disruptive behavior;
Preserve evidence or comply with lawful requests from authorities.

Users acknowledge and agree that JB Empire™ has no duty to display or retain any User content and may remove or restrict it at any time.
7.5 Reporting & Enforcement
Users may report violations through designated reporting mechanisms. JB Empire™ will determine, in its sole discretion, the appropriate response, which may include warnings, editing, removal, shadow-banning, temporary suspension, permanent termination, IP blocking, or referral to law enforcement or regulators.
7.6 No Obligation of Neutrality
JB Empire™ expressly disclaims any obligation to remain neutral in moderation decisions. Users acknowledge that moderation inherently involves judgment and discretion, and agree that JB Empire™ shall not be liable for any perceived inconsistency, delay, or outcome of enforcement actions.
7.7 Indemnification for Community Use
You agree to defend, indemnify, and hold harmless Truth Tunes™, JB Empire™, and their affiliates, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising from or relating to your conduct in Social Features, your User Content, or your violation of these Terms.
7.8 Community Guidelines Integration
Specific community guidelines, policies, or codes of conduct may be published separately or updated periodically. Such guidelines are incorporated by reference into these Terms, and continued use of Social Features constitutes agreement to comply with them.
7.9 Reservation of Rights
All decisions regarding governance, moderation, or management of Social Features are final and made at the sole discretion of JB Empire™. Users waive any and all claims arising from the removal, suspension, modification, or moderation of content or accounts, and expressly waive participation in any class action related to moderation decisions.

8. Music Generation & Creative Works

8.1 Nature of AI-Generated Music
The Platform provides tools and services that generate musical works, audio compositions, or related creative outputs using proprietary artificial intelligence technologies (“AI-Generated Music”). Such outputs are generated algorithmically, may not be unique, and may resemble or overlap with pre-existing works. Users expressly acknowledge that JB Empire™ cannot guarantee originality, exclusivity, copyright eligibility, or protection of AI-Generated Music.
8.2 Ownership & License of AI-Generated Music
Unless otherwise expressly stated in writing, Users are granted a limited, revocable, non-exclusive, non-transferable, worldwide license to download, use, and share AI-Generated Music for personal, non-commercial purposes only.

JB Empire™ retains all right, title, and interest in and to the underlying algorithms, models, training data, frameworks, systems, and outputs of the AI technologies.
No ownership rights in the AI technology or its outputs are transferred to Users.
Any commercial or revenue-generating use (including but not limited to sales, licensing, streaming monetization, advertising revenue, or integration into products or services) requires a separate written agreement or license from JB Empire™.

8.3 Permitted Uses
Subject to compliance with these Terms, Users may:

Stream, download, and privately enjoy AI-Generated Music;
Share AI-Generated Music on personal social media accounts, provided attribution to Truth Tunes™ is included where reasonably practicable;
Incorporate AI-Generated Music into non-commercial creative projects (e.g., personal videos, podcasts, social posts), provided such use remains consistent with these Terms.

8.4 Prohibited Uses
Users shall not:

Copy, reproduce, distribute, sell, license, or otherwise commercially exploit AI-Generated Music without prior written authorization;
Claim AI-Generated Music, in whole or in part, as an original authored work for purposes of copyright registration, licensing, or commercial exploitation;
Remix, modify, or adapt AI-Generated Music and present such derivative works as wholly original, unless expressly permitted under a separate license;
Use AI-Generated Music in connection with defamatory, obscene, hateful, discriminatory, misleading, infringing, or otherwise unlawful material;
Remove, obscure, disable, or alter any watermarks, metadata, attribution tags, or automated attribution mechanisms included in AI-Generated Music.

8.5 Attribution
While not always mandatory, Users are strongly encouraged to credit Truth Tunes™ when sharing or distributing AI-Generated Music. JB Empire™ reserves the right to require attribution in specific contexts or implement automated attribution systems.
8.6 Reservation of Rights
JB Empire™ expressly reserves the right to:

Reuse, remix, modify, or redistribute AI-Generated Music for any purpose, including commercial and promotional use;
Monitor, review, and audit User use of AI-Generated Music to ensure compliance with these Terms;
Offer and enforce paid licensing options for commercial or revenue-generating exploitation, with customized rights and royalty structures.

8.7 No Guarantee of Exclusivity or Copyright Protection
Users acknowledge that:

AI-Generated Music may be similar or identical to outputs provided to other Users;
JB Empire™ makes no representation or warranty regarding the exclusivity, originality, or copyright protectability of AI-Generated Music;
Users may not rely on AI-Generated Music for claims of intellectual property ownership or originality.

8.8 User Responsibility & Indemnification
Users assume full responsibility for their use of AI-Generated Music, including ensuring compliance with third-party rights, applicable laws, and platform rules of distribution services.
Users agree to defend, indemnify, and hold harmless JB Empire™, Truth Tunes™, and their affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, or expenses (including attorneys’ fees) arising out of or related to:

User use, sharing, or distribution of AI-Generated Music;
Any allegation that User’s use of AI-Generated Music infringes, misappropriates, or violates the rights of any third party;
Disputes or enforcement actions arising from monetization, distribution, or derivative use of AI-Generated Music.

9. Purchases, Sales & Merchandise

9.1 Scope of Commerce
The Platform may offer digital goods (including but not limited to AI-Generated Music, downloads, subscriptions, and licenses) and physical goods (including but not limited to branded merchandise or tangible products) (collectively, “Products”). By purchasing Products, Users agree to be bound by these Terms and any supplemental policies applicable to such transactions.
9.2 Pricing & Availability
All prices are listed in U.S. dollars unless otherwise stated and are subject to change without notice. JB Empire™ does not guarantee the availability of any Product and reserves the right to limit quantities, discontinue items, or modify offerings at its sole discretion. In the event of a pricing error, JB Empire™ reserves the right to cancel or refuse any order placed at the incorrect price.
9.3 Payment Processing & Chargebacks
Payments are processed through third-party providers. By submitting payment information, Users authorize JB Empire™ and its processors to charge the designated payment method for the total purchase price, including applicable taxes, fees, and shipping costs.
JB Empire™ is not responsible for errors, delays, or security breaches attributable to third-party payment processors.
Users remain responsible for any reversed or disputed charges (including chargebacks). JB Empire™ may suspend or terminate accounts for chargeback abuse and may pursue collection of owed amounts through legal means.
9.4 Taxes & Duties
Users are responsible for any applicable sales, use, value-added, customs, or other taxes or duties imposed by governing authorities in connection with purchases. JB Empire™ may collect and remit certain taxes where legally required but makes no representation regarding User tax obligations.
9.5 Shipping & Delivery of Physical Goods
Estimated delivery times are provided for convenience only and are not guaranteed. Title and risk of loss for physical goods transfer to the User upon delivery to the carrier. JB Empire™ is not liable for shipping delays, damage, or loss once items are in the possession of the carrier.
9.6 Delivery of Digital Goods
Digital Products, including AI-Generated Music or licenses, may be delivered electronically through downloads, email, or account-based access. Delivery to the email address or account associated with the User constitutes full fulfillment of JB Empire’s™ obligations. Users are responsible for maintaining compatible devices, connections, and software to access such Products.
9.7 Refunds & Returns
Digital Goods: All sales of digital Products are final and non-refundable, except where required by law or expressly stated otherwise.
Physical Goods: Eligible physical Products may be returned within thirty (30) days of delivery, provided they are unused, unopened, and in original condition. Return shipping costs are the responsibility of the User unless the return results from JB Empire’s™ error.
JB Empire™ reserves the right to deny refunds, credits, or exchanges in cases of abuse, fraud, or policy violations.
9.8 Licensing of Digital Products
Where expressly indicated, digital Products (such as AI-Generated Music or premium services) are licensed, not sold. Licenses are non-exclusive, non-transferable, revocable, and subject to these Terms. Unauthorized reproduction, resale, sublicensing, or distribution constitutes infringement and may result in termination of access without refund, in addition to legal remedies.
9.9 Subscriptions & Auto-Renewals
If subscription-based services are offered, Users authorize recurring billing until canceled. Users may cancel at any time through account settings, subject to any minimum commitment period disclosed at purchase. Fees paid are non-refundable except as required by law.
9.10 Promotions, Discounts & Gift Codes
Any promotional offers, coupons, or discounts are subject to expiration dates, eligibility requirements, and other conditions specified at issuance. JB Empire™ reserves the right to modify, suspend, or terminate promotions at its sole discretion. Promotions may not be applied retroactively to prior purchases.
9.11 Fraud Prevention & Abuse
JB Empire™ reserves the right to refuse, cancel, or limit any order if fraudulent, unauthorized, or abusive activity is suspected. Such activity may also result in account suspension or termination. Users engaging in fraud, resale of licenses, or other misuse may be subject to civil or criminal liability.
9.12 International Compliance
Certain consumer protection, cancellation, or refund rights may apply to Users located outside the United States. JB Empire™ will comply with such rights only to the extent required by applicable law. Users remain responsible for understanding and complying with their own local regulations regarding purchases and digital content.
9.13 Reservation of Rights
All sales and licensing of Products are subject to availability and to JB Empire’s™ sole discretion. JB Empire™ reserves the right to modify store policies, pricing, shipping methods, refund practices, and product offerings at any time without prior notice, to the fullest extent permitted by law.

JB Empire™’s total liability for any claim relating to data security shall not exceed the total fees paid by the User to JB Empire™ in the twelve (12) months preceding the claim.

11.5 User Responsibilities
Users are responsible for:

Maintaining the confidentiality of login credentials and API keys;
Securing their devices and network environments;
Ensuring the security of any integrations, plugins, or APIs they connect to the Platform;
Promptly reporting any suspected unauthorized access or breaches to JB Empire™.

11.6 Third-Party Risks
Users acknowledge that third-party service providers (including cloud hosting, payment processors, or analytics services) may process or store data on our behalf. JB Empire™ is not responsible for the security practices or breaches of such third parties, except as required by applicable law.

11.8 Survival
The provisions of this Section 11, including limitations of liability and User responsibilities, shall survive the termination of a User’s account or use of the Platform.

Users acknowledge and agree that:

Accessing or using Third-Party Services is at their own risk;
Users must comply with the applicable terms, conditions, and privacy policies of any Third-Party Service;
JB Empire™ shall not be liable for any loss, damage, or disputes arising from interaction with, or reliance upon, Third-Party Services;
Users shall indemnify and hold harmless JB Empire™ from any claims, damages, or liabilities arising from their use of Third-Party Services.

The Platform may integrate with third-party tools or APIs, including but not limited to: social media platforms, payment processors, analytics services, cloud hosting providers, or AI-related services.

Such integrations are subject to the third party’s terms and privacy policies.
JB Empire™ does not guarantee the functionality, security, availability, or continued operation of these tools.
Users consent to any data sharing or processing necessary to facilitate these integrations and acknowledge that JB Empire™ is not responsible for the data handling practices of such third parties, except to the extent required by law.

References to or inclusion of Third-Party Services do not constitute approval, sponsorship, or endorsement by JB Empire™. Users should perform their own due diligence before engaging with any third-party offerings.

To the fullest extent permitted by law, JB Empire™ disclaims all liability arising from or relating to:

User access to, use of, or reliance on Third-Party Services;

Warranties of merchantability, fitness for a particular purpose, non-infringement, and title;
Warranties that the Services will be uninterrupted, timely, error-free, secure, or free of viruses, malware, or other harmful components;
Warranties regarding the accuracy, reliability, availability, legality, or usefulness of any content, AI-generated outputs, or third-party materials accessed through the Services;
Warranties against loss, corruption, or unauthorized disclosure of data.

13.2 User Assumption of Risk

Users acknowledge and agree that:

Use of the Services is at their sole risk;
AI outputs may be inaccurate, misleading, offensive, infringing, or otherwise unsuitable for reliance in professional, medical, legal, financial, or safety-critical contexts;
Users remain solely responsible for verifying the accuracy, legality, and appropriateness of any content, data, or outputs they use, share, or rely upon;
Any reliance on the Services or outputs is undertaken entirely at the User’s discretion and risk;
The Services may be subject to interruptions, delays, or discontinuation, including due to maintenance, system overloads, or third-party dependencies.

13.3 Limitation of Liability

To the fullest extent permitted by law, JB Empire™ (including its affiliates, officers, employees, contractors, licensors, and agents) shall not be liable for:

Any indirect, incidental, consequential, exemplary, special, statutory, or punitive damages;
Loss of profits, revenue, goodwill, data, business opportunities, or anticipated savings;
Damages arising from:
(a) the use of or inability to use the Services;
(b) reliance on AI outputs or third-party content;
(c) unauthorized access to, alteration of, or loss of data;
(d) service interruptions, system failures, or downtime;
(e) viruses, malware, or other harmful components transmitted through the Services;
(f) actions, omissions, or content of third parties; or
(g) events beyond JB Empire’s™ reasonable control, including force majeure events.

13.4 Maximum Liability Cap

In no event shall the total aggregate liability of JB Empire™ to any User for all claims arising out of or relating to these Terms, the Services, or any AI-generated outputs exceed the greater of:
(a) twenty U.S. dollars (US $20), or
(b) the amount actually paid by the User to JB Empire™ for use of the Services during the twelve (12) months preceding the claim.

13.5 No Class Actions or Representative Claims

To the fullest extent permitted by law, all disputes, claims, and causes of action arising out of or relating to these Terms or the Services must be brought by Users in their individual capacity only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. No proceeding shall be joined or combined with another without JB Empire’s™ prior written consent.

13.6 Jurisdictional Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation/exclusion of liability for consequential or incidental damages. To the extent such laws apply, some of the above exclusions or limitations may not apply to certain Users. In such cases, JB Empire’s™ liability shall be limited to the maximum extent permitted by law.

13.7 Survival

The disclaimers, limitations, and restrictions set forth in this Section 13 shall survive termination of these Terms, closure of User accounts, or cessation of use of the Platform.

14. Termination of Accounts

14.1 Grounds for Termination
JB Empire™ reserves the right, in its sole discretion and without prior notice, to suspend, restrict, or terminate any User account or access to the Platform if:

The User violates, or is reasonably suspected of violating, these Terms;
The User engages in fraud, abuse, harassment, illegal activity, or other harmful conduct;
The User misuses or exploits the AI services, trademarks, or intellectual property of JB Empire™;
The User’s actions present a risk to the security, stability, or reputation of the Platform or its community;
Required by law, regulation, or governmental request;
The account has been inactive for an extended period, as determined in JB Empire’s™ discretion; or
For any reason or no reason, subject only to applicable law.

14.2 Voluntary Termination by Users
Users may terminate their accounts at any time by following the account closure procedures provided within the Platform. Upon termination, all licenses, rights, and access granted under these Terms shall immediately cease.

14.3 Effect of Termination
Upon termination of a User account, regardless of cause:

Access to the Platform and Services will immediately cease;
Any stored or generated content, including AI Outputs, may be deleted, archived, or retained at JB Empire’s™ discretion, subject to applicable law and the Privacy Policy;
Users remain responsible for all outstanding obligations, including payment obligations, indemnities, or violations incurred prior to termination;
Termination does not entitle Users to refunds, credits, or compensation of any kind, except where expressly required by law.

14.4 Retention for Legal & Compliance
JB Empire™ may retain User data, content, transaction records, or communications as necessary to comply with legal obligations, enforce these Terms, resolve disputes, or maintain business continuity.

14.5 No Liability for Termination
To the fullest extent permitted by law, JB Empire™ shall not be liable for any damages, losses, or costs arising from suspension, restriction, or termination of access, including but not limited to loss of data, AI outputs, business opportunities, revenue, goodwill, or anticipated savings, whether foreseeable or unforeseeable.

14.6 Survival of Obligations
The following provisions shall survive termination of an account or these Terms: Intellectual Property & Ownership (Section 2), AI Services (Section 4), User Content & Conduct (Section 5), License Granted by Users (Section 6), Disclaimers & Limitation of Liability (Section 13), Governing Law & Jurisdiction (Section 17), Indemnification (Section 20), and any other provisions which by their nature are intended to survive.

14.7 Appeal Process
Where feasible, JB Empire™ may provide Users the opportunity to appeal account suspensions or terminations. Appeals must be submitted in writing within fourteen (14) days of notice. JB Empire™ retains sole discretion to accept, reject, or modify suspension/termination decisions, and such determinations are final.

15. Changes to Terms

15.1 Right to Modify
JB Empire™ reserves the right, in its sole discretion, to amend, modify, update, or replace these Terms at any time, in whole or in part. Such changes may reflect updates to business practices, technology, legal or regulatory requirements, or improvements to the Platform and Services. JB Empire™ shall determine, in its sole discretion, whether a change is “material” or non-material.

15.2 Notice of Changes
Where required by law, material changes to these Terms will be communicated to Users through reasonable means, which may include:

Posting the updated Terms on the Platform with a revised “Last Updated” date;
Providing notice via email or in-platform notifications; or
Other methods deemed appropriate by JB Empire™.

15.3 Continued Use as Acceptance
Your continued access to or use of the Platform following the posting or effective date of updated Terms constitutes your binding acceptance of such changes. If you do not agree with the revised Terms, you must immediately discontinue use of the Platform and close your account.

15.4 Retroactive Application
Unless otherwise stated, changes to these Terms apply prospectively from the date of posting. However, JB Empire™ reserves the right to apply changes retroactively where necessary to comply with law, protect the Platform, enforce intellectual property rights, or uphold community standards. Updates may also apply to previously created or submitted content, data, or AI outputs, where reasonably necessary to ensure consistency with the revised Terms.

15.5 New Features & Services
Any new features, tools, services, or functionality added to the Platform are subject to these Terms as modified, effective immediately upon release, unless expressly stated otherwise.

15.6 No Obligation to Notify Individually
Except as required by law, JB Empire™ is under no obligation to provide Users with individual notice of updates to these Terms. It is the User’s responsibility to review these Terms periodically for updates.

15.7 Controlling Version
In the event of any conflict between prior versions of these Terms and the most current version, the most current version shall prevail and govern.

The provisions of this Section 15 shall survive termination of these Terms or any User account.

17. Governing Law & Jurisdiction

17.1 Governing Law

17.2 Jurisdiction & Venue

If you access or use the Platform from outside the United States, you are solely responsible for compliance with all applicable local laws. JB Empire™ makes no representation that the Platform or Services are appropriate, lawful, or available in other jurisdictions, and access is prohibited from territories where the Services are illegal.

To the extent these Terms are translated into other languages, the English version shall control in the event of any conflict or inconsistency.

18. Severability & Waiver

18.1 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect. Where possible, an invalid, illegal, or unenforceable provision shall be modified to reflect the original intent of the parties as closely as possible in a manner that is valid and enforceable.

18.2 Waiver
The failure, delay, or omission by JB Empire™ to enforce any right, remedy, or provision of these Terms shall not constitute a waiver of such right, remedy, or provision. Any waiver must be in writing and signed by an authorized representative of JB Empire™ to be effective.

18.3 No Continuing Waiver
The waiver of any breach, default, or non-compliance shall not constitute a waiver of any subsequent or continuing breach, default, or non-compliance.

19. Entire Agreement

19.1 Complete Agreement
These Terms, together with any policies, guidelines, or additional terms expressly incorporated by reference, constitute the entire agreement between JB Empire™ and the User concerning the subject matter herein, and supersede all prior or contemporaneous communications, representations, understandings, or agreements, whether written, oral, or electronic.

19.2 No Reliance on Outside Statements
Users acknowledge and agree that they have not relied upon any statement, promise, or representation not expressly set forth in these Terms, and that no oral or written information provided by JB Empire™, its representatives, or any third party shall create any additional obligation or warranty not explicitly contained herein.

19.3 Amendments in Writing
No amendment, modification, or waiver of these Terms shall be valid unless made in writing and signed or electronically accepted by JB Empire™.

19.4 No Third-Party Beneficiaries
These Terms are intended solely for the benefit of the User and JB Empire™ and do not create any rights or remedies for any third party.

19.5 Headings
Headings and section titles in these Terms are for convenience only and shall have no legal or contractual effect.

20. Warranties & Representations

20.1 User Representations
By accessing or using the Platform, Users represent and warrant that:

They have the full legal right, authority, and capacity to enter into and comply with these Terms;
They are not prohibited from using the Platform under any applicable law or regulation;
Any information provided during account creation or use of the Platform is accurate, current, and complete, and will be kept up to date.

20.2 Content Ownership & Rights
Users represent and warrant that:

They own or otherwise possess all necessary licenses, rights, consents, and permissions to post, upload, display, distribute, or otherwise make available any User Content on the Platform;
Such User Content does not infringe, misappropriate, or violate the intellectual property, moral rights, privacy, publicity rights, contractual rights, or any other rights of any third party;
They have obtained all necessary consents and permissions from any individuals whose names, images, likenesses, voices, or performances appear in the User Content.

20.3 Compliance with Law & Policy
Users further represent and warrant that their conduct and User Content:

Complies with all applicable laws, regulations, and industry standards;
Does not contain or promote harmful, unlawful, or malicious material, including but not limited to malware, fraudulent schemes, or prohibited goods/services;
Complies with these Terms, including the Community Guidelines and all applicable policies published by JB Empire™.

20.4 Use of AI Outputs
Users acknowledge and warrant that:

They understand AI Outputs are generated automatically and may be inaccurate, incomplete, or inappropriate;
They will not rely on AI Outputs as a substitute for professional, legal, medical, financial, or other expert advice;
They are solely responsible for verifying the accuracy, legality, and appropriateness of any AI Outputs before using or distributing them.

20.5 Indemnification for Breach and Conduct
Users agree to defend, indemnify, and hold harmless JB Empire™, its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any and all claims, actions, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to:

Any breach of these warranties or representations;
Any User Content or conduct in connection with the Platform;
Misuse of AI Outputs or Services;
Violation of applicable laws or third-party rights.

This indemnification obligation shall survive termination of these Terms and use of the Platform.

21. Indemnification

21.1 User Obligation
To the fullest extent permitted by law, Users agree to defend, indemnify, and hold harmless JB Empire™ (operating as “Truth Tunes™”), its affiliates, officers, directors, employees, contractors, licensors, service providers, and agents (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, suits, proceedings, liabilities, damages, losses, fines, penalties, costs, and expenses (including reasonable attorneys’ fees, court costs, settlements, and judgments) arising out of or relating to:

User’s access to or use of the Platform or Services;
User Content submitted, uploaded, displayed, distributed, or otherwise made available by the User;
User’s breach of these Terms, including any representations, warranties, or obligations contained herein;
User’s violation of any applicable law, regulation, or third-party right, including but not limited to intellectual property, privacy, or publicity rights;
Any misuse of the Platform or Services, including fraud, abuse, negligence, or unlawful activity, whether intentional or not;
Any activity conducted through the User’s account, whether authorized or unauthorized.

21.2 Defense & Control
JB Empire™ reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User. In such cases, the User agrees to cooperate fully with JB Empire™ in asserting any available defenses and shall not settle any claim without JB Empire’s™ prior written consent.

21.3 Independent Obligation
The indemnification obligations hereunder are independent of, and not limited by, any insurance coverage maintained by the User or any other remedies available to the Indemnified Parties.

21.4 Survival
The obligations set forth in this Section shall survive the termination or expiration of these Terms, closure of the User’s account, or cessation of use of the Platform.

22. Beta / Experimental Features Disclaimer

22.1 Nature of Beta Features
The Platform may, from time to time, provide access to experimental, beta, or early-release features (“Beta Features”). Beta Features are made available solely for evaluation, testing, and feedback purposes and do not form part of the standard, fully supported Platform or Services.

22.2 Subject to Change or Removal
Beta Features may be incomplete, unstable, contain errors, or operate differently than the final release. JB Empire™ may modify, suspend, or permanently remove Beta Features at any time, with or without notice, and has no obligation to make any Beta Feature commercially available.

22.3 No Warranties
Beta Features are provided strictly “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, title, or non-infringement. No service levels, support obligations, or commitments applicable to the Platform extend to Beta Features.

22.4 User Acknowledgment & Risk
By choosing to access or use Beta Features, Users acknowledge and agree that:

Beta Features may malfunction or produce inaccurate, incomplete, or unintended results;
Reliance on Beta Features for professional, commercial, medical, financial, or legal purposes is expressly at the User’s own risk;
JB Empire™ shall not be responsible or liable for any loss, damage, data corruption, downtime, or other adverse consequence arising out of or relating to Beta Features.

22.5 Feedback
Any feedback, suggestions, or recommendations submitted regarding Beta Features shall be deemed non-confidential and become the sole and exclusive property of JB Empire™, without compensation, credit, or attribution to the User. JB Empire™ may freely use, copy, modify, or implement such feedback for any purpose.

22.6 Survival
The disclaimers, limitations, and rights set forth in this Section shall survive any discontinuation of or User access to Beta Features.

23. Force Majeure

23.1 Events Beyond Control
JB Empire™ shall not be liable or responsible for any failure or delay in performance, in whole or in part, resulting from causes or circumstances beyond its reasonable control, including but not limited to:

natural disasters, acts of God, fire, flood, earthquake, storm, or explosion;
war, terrorism, armed conflict, civil unrest, strikes, lockouts, or labor disputes;
pandemics, epidemics, or public health emergencies;
governmental actions, embargoes, sanctions, regulations, or orders;
interruption or failure of utilities, telecommunications, internet service providers, hosting providers, or data networks;
cyberattacks, denial-of-service attacks, or other malicious acts by third parties.

23.2 Suspension of Obligations
In the event of a Force Majeure occurrence, JB Empire™’s obligations under these Terms shall be suspended for the duration of the event and for a reasonable recovery period thereafter. JB Empire™ shall use commercially reasonable efforts to mitigate the impact of such events and to resume performance as soon as practicable.

23.3 Extended Force Majeure
If a Force Majeure event continues for more than thirty (30) consecutive days, JB Empire™ may, in its sole discretion, terminate or modify the affected Services without liability, upon written or electronic notice to Users.

23.4 Payment Obligations
Force Majeure shall not excuse or delay any User’s obligation to pay amounts properly due and owing under these Terms, except to the extent payment systems themselves are directly impacted by the Force Majeure event.

23.5 Notice
Where reasonably practicable, JB Empire™ will provide Users with notice of a Force Majeure event and its expected duration. Failure to provide such notice shall not affect the application of this Section.

23.6 No Liability
Users acknowledge and agree that JB Empire™ shall not be liable for any loss, damage, delay, or failure to perform caused directly or indirectly by Force Majeure events.

24. Export Controls & Compliance

24.1 Compliance with Laws
Users acknowledge and agree that their access to and use of the Platform is subject to all applicable export control, trade, and economic sanctions laws and regulations of the United States and any other relevant jurisdiction, including but not limited to those administered by the U.S. Department of Commerce (Bureau of Industry and Security), the U.S. Department of State, and the U.S. Department of the Treasury (Office of Foreign Assets Control), as well as comparable authorities in other jurisdictions.

24.2 Prohibited Destinations & Parties
Users may not access, use, export, re-export, transfer, or otherwise make available the Platform, its services, or any related technology or data:

to or from any country, entity, or individual subject to U.S. or international embargoes, sanctions, or trade restrictions;
to any person or organization listed on any government-maintained restricted parties list (including but not limited to the OFAC Specially Designated Nationals List, the BIS Denied Persons List, and the EU Consolidated Sanctions List);
for any use prohibited under applicable export laws, including nuclear, missile, chemical, or biological weapons activities.

24.3 User Obligations
Users represent and warrant that they:

are not located in, under the control of, or a national or resident of any restricted country or territory;
are not identified on any restricted or denied party list;
will not use the Platform for any purpose prohibited by applicable laws, including but not limited to the development, design, manufacture, or production of weapons of mass destruction.

24.4 Reservation of Rights
JB Empire™ reserves the right to restrict, suspend, or terminate access to the Platform immediately, without notice, if it reasonably believes that a User has violated export control or sanctions laws. JB Empire™ may also cooperate with government authorities to the extent required by law.

24.5 Survival
The obligations set forth in this Section shall survive termination or expiration of these Terms.

Host, store, cache, index, reproduce, transmit, distribute, publicly display, publicly perform, adapt, modify, translate, and create derivative works of the User Content, in whole or in part, in any media or format now known or hereafter developed;

Use, analyze, and process User Content to operate, maintain, improve, promote, and train the Platform and its AI-powered models, algorithms, and services;

Make User Content available to other users of the Platform in accordance with your account settings and the functionality of the Platform;

Sublicense User Content to trusted third-party vendors, partners, hosting providers, or marketing affiliates as reasonably necessary to operate, enhance, secure, or promote the Platform.

You own or otherwise control all rights necessary to grant the license set forth in this Section;

The User Content does not and will not infringe, misappropriate, or violate the intellectual property, privacy, publicity, or proprietary rights of any third party;

The User Content complies with these Terms and all applicable laws;

You have obtained and will maintain all necessary consents, waivers, or releases from individuals, entities, or rights-holders appearing in or contributing to your User Content.

6.5 Termination of License Upon deletion of your User Content from the Platform, Truth Tunes™ will use commercially reasonable efforts to remove it from active display. However, you acknowledge and agree that:

Deleted User Content may persist in cached, backup, archival, or log copies for a commercially reasonable period of time;

User Content already sublicensed, shared, or used in accordance with this Section may continue to exist and be accessible or used by others, subject to their own rights and obligations;

Truth Tunes™ may retain and use copies of your User Content as reasonably necessary to comply with legal obligations, enforce these Terms, resolve disputes, prevent fraud, and maintain operational continuity.

Truth Tunes™ asserts and reserves all rights, title, and interest in and to the proprietary algorithms, frameworks, prompts, training data, and system outputs underlying or contributing to AI-Generated User Content.

Users retain ownership of any original, protectable contributions they make to AI-Generated User Content (e.g., lyrics, recordings, or creative input provided directly by the User).

In jurisdictions where AI-Generated works may not qualify for copyright protection, Users acknowledge that they may have limited or no enforceable rights in AI-Generated User Content and that Truth Tunes™ may continue to use, display, or distribute such content without liability.

You will not use the AI tools to generate infringing, unlawful, defamatory, or otherwise prohibited content;

You understand and agree that AI-Generated User Content may resemble or overlap with works created by others using the Platform or other AI systems, and that such similarity does not entitle you to exclusive rights or remedies;

You assume all risk that AI-Generated User Content may not be eligible for intellectual property protection in your jurisdiction.

6.7.5 Waiver of Claims You waive any claim against Truth Tunes™, JB Empire™, or their affiliates arising from:

Similar or identical AI-Generated outputs produced for other Users;

The use, distribution, or commercialization of AI-Generated User Content by Truth Tunes™ or third parties acting under license;

The inability to obtain or enforce exclusive intellectual property rights in AI-Generated User Content.

6.7.6 Survival All licenses, waivers, and disclaimers set forth in this Section 6.7 survive termination of your account and apply retroactively to any AI-Generated User Content created during your use of the Platform.

7. Social Features & Community Guidelines

Treat others with respect, civility, and fairness;

Avoid harassment, bullying, stalking, discrimination, intimidation, or targeted abuse;

Keep discussions relevant, accurate, and constructive;

Protect minors and vulnerable individuals by refraining from harmful or exploitative conduct;

Promptly report violations or harmful behavior through the Platform’s reporting tools.

7.3 Prohibited Conduct in Social Features Without limitation, Users shall not:

Post, transmit, or distribute unlawful, defamatory, obscene, hateful, violent, pornographic, exploitative, or otherwise harmful material;

Engage in spam, solicitation, multi-level marketing, commercial advertising, or self-promotion without express authorization;

Misrepresent identity, impersonate others, mislead Users, or create multiple/fraudulent accounts to evade restrictions or suspensions;

Solicit, exploit, or endanger minors, or distribute sexually explicit, suggestive, or exploitative content;

Use Social Features for scams, phishing, fraudulent schemes, or to distribute malware or malicious code;

Interfere with normal operation of the Platform, disrupt community events, or attempt to manipulate ranking, visibility, or engagement metrics.

7.4 Moderation Rights JB Empire™ reserves the absolute right, but not the obligation, to monitor, screen, edit, remove, archive, or disable access to any content, communication, or account, in whole or in part, at its sole discretion and without notice. This includes actions taken to:

Enforce these Terms, Community Guidelines, or applicable law;

Protect the safety, security, and integrity of the Platform and its Users;

Address complaints, violations, or disruptive behavior;

Preserve evidence or comply with lawful requests from authorities.

8. Music Generation & Creative Works

JB Empire™ retains all right, title, and interest in and to the underlying algorithms, models, training data, frameworks, systems, and outputs of the AI technologies.

No ownership rights in the AI technology or its outputs are transferred to Users.

Any commercial or revenue-generating use (including but not limited to sales, licensing, streaming monetization, advertising revenue, or integration into products or services) requires a separate written agreement or license from JB Empire™.

8.3 Permitted Uses Subject to compliance with these Terms, Users may:

Stream, download, and privately enjoy AI-Generated Music;

Share AI-Generated Music on personal social media accounts, provided attribution to Truth Tunes™ is included where reasonably practicable;

Incorporate AI-Generated Music into non-commercial creative projects (e.g., personal videos, podcasts, social posts), provided such use remains consistent with these Terms.

8.4 Prohibited Uses Users shall not:

Copy, reproduce, distribute, sell, license, or otherwise commercially exploit AI-Generated Music without prior written authorization;

Claim AI-Generated Music, in whole or in part, as an original authored work for purposes of copyright registration, licensing, or commercial exploitation;

Remix, modify, or adapt AI-Generated Music and present such derivative works as wholly original, unless expressly permitted under a separate license;

Use AI-Generated Music in connection with defamatory, obscene, hateful, discriminatory, misleading, infringing, or otherwise unlawful material;

Remove, obscure, disable, or alter any watermarks, metadata, attribution tags, or automated attribution mechanisms included in AI-Generated Music.

Reuse, remix, modify, or redistribute AI-Generated Music for any purpose, including commercial and promotional use;

Monitor, review, and audit User use of AI-Generated Music to ensure compliance with these Terms;

Offer and enforce paid licensing options for commercial or revenue-generating exploitation, with customized rights and royalty structures.

8.7 No Guarantee of Exclusivity or Copyright Protection Users acknowledge that:

AI-Generated Music may be similar or identical to outputs provided to other Users;

JB Empire™ makes no representation or warranty regarding the exclusivity, originality, or copyright protectability of AI-Generated Music;

Users may not rely on AI-Generated Music for claims of intellectual property ownership or originality.

User use, sharing, or distribution of AI-Generated Music;

Any allegation that User’s use of AI-Generated Music infringes, misappropriates, or violates the rights of any third party;

Disputes or enforcement actions arising from monetization, distribution, or derivative use of AI-Generated Music.
